$12 Million Medical Malpractice Settlement
The estate of a disabled husband and father alleged that the defendant doctor, as well as the defendant hospital through its nursing staff and residents, negligently cared for the patient during and subsequent to a laparoscopic appendectomy (removal of the appendix through a laparoscope), which allegedly resulted in two strokes and permanent disability to the patient.
$10 Million Medical Malpractice Settlement
The estate of a deceased husband and father alleged that the man died as a result of the negligence of the defendant cardiologists in failing to appropriately work-up and recommend surgical treatment for his mitral valve prolapse.
$5 Million Medical Malpractice Verdict
In May, 2006, Brian Hurst and Ernest W. Beutel, obtained an Illinois record $5 Million verdict in the Circuit Court of Cook County on behalf of a 57-year-old woman and her husband, formerly of DuPage County. It was alleged that the patient suffered the functional loss of her vagina as a result of an unnecessary suburethral sling procedure for stress urinary incontinence. The sling procedure, which was alleged to have been unnecessary due to the fact that the patient did not suffer from stress urinary incontinence, eroded into the patient’s vagina post-operatively, resulting in permanent and disabling scarring and infection and necessitating several surgical procedures. $4.565 Million Medical Malpractice Settlement
It was alleged that the patient presented to defendant hospital with chest pain, coughing and fever. She was diagnosed with pneumonia and sent home. Three days later she returned suffering respiratory difficulty. Her blood gas tests showed that the oxygen content of her blood was decreased and decreasing. She was ultimately unsuccessfully intubated, resulting in hypoxic brain damage which left her in a permanent vegetative state.
$4.543 Million Automobile Personal Injury Verdict
Thomas Boleky obtained the second highest personal injury verdict in Kane County's history at the time. Plaintiff was severely injured while riding as a passenger in the back seat of a car struck by Defendant's pizza delivery vehicle.
$4.5 Million Medical Malpractice Settlement
It was alleged that the patient, a 49-year-old female, suffered a debilitating stroke as a result of a carotid artery stenting procedure which was alleged to have been experimental, unnecessary considering the nature and extent of her carotid artery disease and performed negligently. The patient had a history of strokes and the defense contended that the procedure was appropriate and necessary for her condition and not performed in a negligent manner.
$4.035 Million Wrongful Death From Electrocution Settlement
An industrial painter was working under the Chicago Transit Authority's elevated tracks when an electrical shock caused him to fall forward into a JLG lift which crushed him to death. He was survived by his wife and three children, one of which was a starting tackle for the Notre Dame football team.
$4 Million Medical Malpractice Settlement
It was alleged that the patient, a 25-year-old female, suffered injury to her duodenum during the performance of an ERCP with biliary sphincterotomy for biliary stenosis which resulted in disability and disfigurement of the patient's abdomen requiring several additional surgical procedures.
$3.75 Million Automobile/Motorcycle Personal Injury Verdict
Plaintiff was struck by Defendant's Ford-150 pickup truck while riding his motorcycle. Plaintiff suffered from multiple fractures, including his pelvis, leg, and nose. The injury to his right leg was so severe it had to be amputated above the knee.
$3.25 Million Gas Explosion Personal Injury Settlement
Thomas Boleky secured a $3.25 Million settlement in the Circuit Court of Cook County for Plaintiff against People's Gas Light & Coke Company. The Plaintiff survived a natural gas explosion in his Chicago home, but suffered third-degree burns on his face, neck, arms, and upper body.
$3 Million Product Liability Wrongful Death Verdict
Defendant company negligently setup and monitored house arrest ankle bracelet worn by felon on parole, which failed to notify police that felon had left his home, during which time the felon shot Plaintiff with a hand gun.
$2.65 Million Verdict for Medical Malpractice resulting in Blind Eye
Plaintiff presented to Defendant ophthamologist with a chalazion, or small pimple like bump, on his left lower eyelid. The Defendant injected Plaintiff's eyelid with corticosteriod, which entered the central retinal artery causing loss of vision in the Plaintiff's left eye due to ischemia.
$2.5 Million Bicycle Personal Injury Settlement
Thomas Boleky obtained a $2.5 Million settlement from the Village of Palos Heights during the third day of trial for a woman who suffered spinal cord trauma and paralysis after being injured on a municipal bicycle path when her bike pedal hit a short steel post located in the middle of the path and she was thrown to the ground.
$2.5 Million Personal Injury Settlement
Thomas Boleky obtained a $2.5 Million settlement in the Circuit Court of Lake County. Golf cart owned by Defendant rolled over as Plaintiff drove the cart around a sharp curve in path at Defendant's golf course. Plaintiff was partially paralyzed from his resulting cervical cord injury, losing function in both legs and his fingers, as well as requiring surgical fusion and titanium plating in his neck.
$2.4 Million Medical Malpractice Verdict
Brian Hurst obtained a $2.4 Million verdict in the Circuit Court of Cook County against St. Francis Hospital of Blue Island, Illinois, and its emergency room physician. It was alleged that the patient, a 51-year-old male, presented to the Emergency Room of the defendant hospital with an acute arterial insufficiency of his right lower extremity following a fall at his home. As a result of the failure to properly and timely diagnose and treat the acute arterial insufficiency with an emergent re-vascularizaton procedure, the patient suffered an above the knee amputation of his right leg the following day.
$2 Million Medical Malpractice Settlement
It was alleged that the Defendant Doctor negligently handled the fractured leg of the patient, a 48-year-old male, which resulted in infection requiring several subsequent operative procedures and severe disability to the patient’s leg. The defense paid the full extent of the defendant's liability insurance on the eve of trial.
$2 Million Wrongful Death Settlement
Woman was changing the tire of her van parked on the side of the road when she was killed by Defendant's car. Prior to her death, police had setup a number of warnings to oncoming traffic, including a parked police car with emergency lights, traffic cones, flares, and a police officer directing traffic. Despite all warnings, Defendant swerved his car into oncoming traffic to get around woman's van and causing a car wreck, killing the woman.
$1.5 Million Medical Malpractice Settlement
It was alleged that the patient, a 67-year-old male, died as a result of the Defendant Doctor's negligence in lacerating the patient's vena cava during the performance of a liver resection for liver cancer.
$1.5 Million Automobile Wrongful Death Settlement
Plaintiff was a passenger in a car struck on Illinois Interstate Highway 80 by a merging truck owned by Defendant shipping company. The collision caused Plaintiff's car to crash into a concrete median post, killing Plaintiff.
$1.45 Million Automobile Personal Injury and Dramshop Verdict
Thomas Boleky obtained a $1.45 Million settlement in the Circuit Court of Will County. On the same day as her Uncle's funeral, Plaintiff was riding home from Defendant's bar in her ex-boyfriend's car when the car crossed railroad tracks and was struck by an on-coming train. Plaintiff suffered numerous fractures, including to both hips and legs, her wrist, and her chest, as well as suffering lacerations to her face.
$1.365 Million for Death From Electrocution Verdict
Worker killed by construction company's concrete truck, parked too close to electrical wires, drew electricity from surrounding wires and electrocuted Plaintiff for over 30 seconds before his lifeless body was pried away by co-workers.
$1.3 Million Pedestrian-Automobile Personal Injury Settlement
Thomas Boleky obtained a $1.3 Million settlement in the Circuit Court of DuPage County for a woman's estate after she was killed when struck by Defendant's car as she crossed the road after eating breakfast at a nearby restaurant. She suffered multiple injuries, including a fractured skull, fractured ribs, and a heart attack, all leading to her death.
$1.22 Million Medical Malpractice Settlement
The estate of a deceased mother alleged that the woman died as a result of the negligence of the defendant physician in failing to appropriately manage the patient’s volume status during and subsequent to breast reduction surgery. It was alleged that patient suffered from excessive blood loss and inadequate fluid and blood replacement which resulted in a cardiopulmonary arrest and death.
$1.2 Million Wrongful Death From Drowning Settlement
A five year old child drowned in a municipal swimming pool after wandering from adjacent playground through an unlocked gate leading to pool and while under the supervision of municipal employees. Thomas Boleky secured the settlement for the estate of the child after a week on trial, but before the jury reached a verdict.
$1.125 Construction Personal Injury Verdict
At a Michigan stone yard, a crane operator swung a 1,500 pound granite slab into a fellow co-worker and lowered the slab on top of co-worker, crushing the lower half of his body. The co-worker's injuries included a torn shoulder rotator cuff, numerous fractures including his rib, ankle, and tibia plateau, and multiple soft-tissue injuries
$1.1 Wrongful Death Settlement
Plaintiff's wife was a passenger in friend's car which was struck by garbage truck owned by defendant. The friend was killed on impact. Plaintiff's wife was cut out of the vehicle and flown to hospital, where she was pronounced dead shortly after arriving. It was alleged that the intersection, which was under construction at the time of the incident, was confusing to motorists because the new lane stripping had been applied to the roadway surface however the corresponding traffic control signals had not yet been installed. This led to a situation where a driver may proceed through the intersection with the misconception that traffic on the preferential highway also had to stop.

Beutel Hurst Boleky LLC obtains $1 million settlement (full extent of liability insurance) for medical malpractice related to untreated pericardial effusion resulting in wrongful death of 67-year-old.
$1 Million Wrongful Death Verdict
Thomas Boleky obtained a $1 Million verdict in the Circuit Court of DuPage County. Married couple's house exploded as a result of improper filling of house-utility propane tank by gas company. Explosion occurred while couple was inside house, causing severe second and third degree burns to both husband and wife, as well as other injuries.
$775,352 Medical Malpractice Verdict
Brian Hurst obtained a then Illinois record $775,352 verdict in the Circuit Court of Cook County against a physician on behalf of a 68-year-old woman who had allegedly suffered a foreshortened vagina as a result of a negligently performed surgical correction of a cystocele; i.e., bulging of the bladder into the vagina. At the time this was an Illinois record for gynecological injuries.
$669,520 Medical Malpractice Verdict
Brian Hurst obtained a $669,520 verdict in the Circuit Court of Cook County against a physician on behalf of a woman who had allegedly suffered a vascular injury during what was alleged to have been an unnecessary laparoscopic cholecystectomy (gallbladder removal through a laparoscope).
